Publication Agreement

Submitting a manuscript for publication to JOI indicates that authors have read and agreed to the terms listed within the following publication agreement:

This is a publication agreement (“this agreement”) regarding a written manuscript to be published in the Journal of Open Initiatives in Academic Libraries (“the journal”). 

The parties to this agreement are the corresponding author listed at the time of submission and the journal. 

By agreeing to publication in the journal:

  1. You warrant that you have the authority to act as the agent for all other listed authors of the article for the purpose of entering into this agreement. 

  2. You agree to the application of a Creative Commons license to the article. By default, a Creative Commons Attribution 4.0 International License (CC BY 4.0) will be applied: https://creativecommons.org/licenses/by/4.0/. However, under special circumstances the author can choose another Creative Commons license. In order to accomplish this, the author must include an explanation of their reasons upon submission in the cover letter, and the requested change must be approved by the editorial board. 

  3. You understand that you and all listed authors retain copyright in all versions of the article, and all rights not expressly granted in this agreement.
     
  4. To the extent that any edits made by the journal to make the article suitable for publication in the journal amount to copyrightable works of authorship, the journal hereby assigns all rights, title, and interest in such edits to you. The journal agrees to verify with you any such edits that are substantive. You agree that the license in paragraph 2 covers such edits. 

  5. You further warrant that:
     
    1. The article is the original work of the listed authors, has not been formally published in any other journal or in a book or edited collection, and is not under consideration for any such publication. 

    2. You are the sole author(s) of the article, and that you have a complete and unencumbered right to enter into this agreement. 

    3. The article does not libel anyone, infringe on anyone’s copyright or otherwise violate any statutory or common law right of anyone, and that you have made all reasonable efforts to ensure the accuracy of any factual information contained in the article. You agree to indemnify the journal against any claim or action alleging facts which, if true, constitute a breach of any of the foregoing warranties or other provisions of this agreement, as well as against any related damages, losses, liabilities, and expenses incurred by the journal. 

  6. This is the entire agreement between you and the journal, and it may be modified only in writing. It will be governed by the laws of the United States of America and the State of Texas. It will bind and benefit our respective assigns and successors in interest, including your heirs. It will terminate if the journal does not publish, in any medium, the article within two years of the date of your signature.
